Resumen de Shades of light and darkness: the spanish transposition of EU directives on the rights of suspected and accused persons

Marta Muñoz de Morales Romero

  • Protecting the human rights of individuals facing criminal proceedings is an essential element of the rule of law. It is also a cornerstone for strengthening trust between EU Member States and, therefore, for ensuring effective judicial cooperation in criminal matters. The EU approved a set of procedural directives to strengthen this level of trust. In this paper, the Spanish legal and judicial framework is carefully profiled regarding the rights of suspected and accused persons recognized throughout the Union. The topics it covers include the need for translation and/or interpretation and the quality of any such service provision; effective communication and legal counsel; information on rights in an accessible manner; and practical access to case-related documentation.
