    El Auto comentado recuerda la importancia de las pretensiones invocadas ante el tribunal puesto que éstas determinan los criterios de competencia aplicados. Así, el TJUE subraya de nuevo el alcance limitado de la competencia atribuida en materia matrimonial. Pese a que las normas estatales puedan establecer la obligación de que el juez competente se pronuncie sobre la responsabilidad parental o las obligaciones alimenticias de los hijos menores, si la competencia judicial internacional atribuida por el Reglamento (UE) 2201/2003 se limita exclusivamente a la materia matrimonial (disolución del vínculo matrimonial), no cabe esa posibilidad. El TJUE destaca además el carácter objetivo, alternativo y exhaustivo del elenco de criterios previstos en materia matrimonial en el Reglamento 2201/2003.

    The commented Order of the Court recalls the importance of the claims invoked before the court since they determine the criteria for assessment jurisdiction. Thus, the ECJ underlines once again the limited scope of the jurisdiction conferred in matrimonial matters. State rules may establish the obligation for the competent judge to rule on parental responsibility or child support obligations, however this possibility does not fit when the international jurisdiction attributed by Regulation (EU) 2201/2003 is limited exclusively to matrimonial matter (dissolution of matrimonial ties).
