En el presente estudio, el autor examina el bloque de legalidad vigente en los países de habla hispana respecto de los procesos de tutela colectiva, para luego arribar a una reflexión final sobre qué tan factible es que se materialice una legislación unificada en todo el ámbito de Iberoamérica. Concluye que existirá un menor o un mayor desarrollo, pero en su mayoría encontramos un piso interesante a partir del cual construir los cimientos para la solidificación de una tutela colectiva responsable y eficaz.

In the present study, the author examines the current legislation in the Spanish-speaking countries regarding processes of collective tutelage, to then forseek a final thought on how feasible it is to materialize a unified legislation in Latin America-wide. Finally, the author concludes by asserting that there might be a minor or a major development, but mostly we find an interesting floor from which to build the foundations for the solidification of responsible and effective collective tutelage.
