La democratización de las relaciones colectivas del trabajo en España como alternativa a la flexiseguridad: un debate oculto pero ineludible

    En el presente estudio se analiza de manera crítica la situación actual del marco regulador de la negociación colectiva en España, que ha resultado tanto de la Ley como de la interpretación jurisprudencial surgida a raíz de la misma. Para ello, previamente, se analiza desde un punto de vista comparado el origen del derecho a la negociación colectiva y la fuerza vinculante del Convenio Colectivo, presentado la teoría normativa del pacto colusorio laboral. No obstante, la referencia comparada se mantiene durante todo el estudio a la hora de analizar cada institución, y aunque la comparativa con España se centra en Reino Unido, Alemania y Francia, no se pierden de vista tampoco otros países como Portugal o Italia.

    This study critically analyzes the current situation of the regulatory framework for collective bargaining in Spain, which has resulted both from the Law (reform of 2012) and from the jurisprudential interpretation that emerged from it. For this, previously, the origin of the right to collective bargaining and the binding force of the collective agreement are analyzed from a comparative point of view, presenting the normative theory of the labour anticompetitive agreement. However, the comparative reference is maintained throughout the study when analyzing each institution, and although the comparison with Spain is centered in the United Kingdom, Germany and France, other countries such as Portugal or Italy are taken into account.
