  Se analiza la vulneración del derecho fundamental a la integridad moral del trabajador (art. 15 CE) a raíz de la privación de las tareas del empleado público. Con tal finalidad se deberá de determinar si constituye acoso laboral el hecho de mantener a un funcionario sin desempeñar actividad alguna durante un prolongado periodo de tiempo o si, por el contrario, es necesaria la producción de comportamientos violentos por parte de la administración (como empleadora).

  The violation of the fundamental right to moral integrity of the employee (article 15 of the Spanish Constitution) as a result of the lack of the tasks of the public employee will be analysed. With that aim, it should be determined if it constitutes work harassment the fact of maintaining to one public employee without performing any activity during a prolonged period of time or if, on the contrary, it is necessary the production of violent behaviours on the part of the public administration (as employer).
