Resumen de Atribución de la guarda del menor a un tercero distinto de los progenitores

Este trabajo pretende dar respuesta a los diferentes interrogantes que plantea la posibilidad que prevé el Código Civil de que la guarda de un menor pueda ser atribuida a un tercero distinto de sus progenitores dentro del proceso de ruptura matrimonial. Entre dichos interrogantes se encuentran la naturaleza jurídica de este tipo de guarda, los sujetos legitimados para acordarla, el supuesto de hecho que debe concurrir para que proceda su establecimiento, los momentos en los que puede adoptarse, su duración, los sujetos en los que puede recaer y su contenido concreto.

The purpose of this paper is to answer the various questions raised by the possibility provided for in the Civil Code that the guardianship of a minor may be attributed to a third party other than his or her parents within the process of marital breakdown. Among these questions are the legal nature of this type of guardianship, the subjects legitimized to establish it, the factual situation that must concur for its establishment to proceed, the moments in which it can be adopted, its duration, the subjects in which it can fall and its specific content.
