Resumen de Suspensión de plazos procesales: la interrupción del normal funcionamiento del Poder Judicial durante el Estado de Alarma

En este artículo se pretende analizar si durante los estados de alarma, excepción y sitio puede interrumpirse el normal funcionamiento de uno de los poderes constitucionales del Estado, —el Poder Judicial—, mediante la suspensión casi total de su actividad; se cuestiona si a través de la declaración gubernamental de estado de alarma pueden regularse materias reservadas a la Ley Orgánica; se rechaza que durante el estado de alarma pueda limitarse el derecho a la tutela judicial efectiva; se analizan los problemas procesales que se producirán en los órganos judiciales; y, se ofrecen propuestas de futuro.

This article tries to analyze if during the states of alarm, exception and siege the normal functioning of one of the constitutional powers of the State, the Judiciary, can be interrupted by means of the almost total suspension of its activity; it is questioned if through the governmental declaration of alarm state, matters reserved to the Organic Law can be regulated; it is rejected that during the state of alarm the right to effective remedy may be limited; the procedural problems that will occur in the spanish courts are analyzed; and, future proposals are offered.
