Law 5/2019, on Real Estate Credit Contracts, partially incorporates the provisions of Directive 2014/17/EU, regulating real estate credit contracts, into the Spanish legal system. The law extends the subjective scope provided for in the Directive. The legal regulation will affect borrowers, guarantors or guarantors, even if they are not consumers. However, forgetting the natural consumers, a condition that recognizes Spanish law to some foundations or non-profit societies. With the current regulation these people, despite being consumers, will not be protected by the new Law 5/2019. It may be possible to apply the minimum efficiency referred to in art. 59 of the Consumer Defense Law.
