  Una condición insoslayable para el funcionamiento del mercado único digital en la Unión Europea es incentivar el comercio electrónico transfronterizo y al mismo tiempo brindar la máxima protección a las empresas, pero particularmente a los ciudadanos europeos, quienes son la parte más vulnerable en este tipo de transacciones y los que, por tanto, necesitan mayor protección y seguridad. Es así como la Comisión Europea, como parte de su estrategia para lograrlo, crea la plataforma europea de resolución de conflictos en línea. Dada la relevancia de esta iniciativa, no solo a nivel regional, sino en el mundo, este trabajo hace un análisis crítico de la plataforma en sus primeros años de funcionamiento, a fin de poner de manifiesto sus fortalezas y las oportunidades de mejora, para así establecer hacia dónde debe encaminar sus esfuerzos para lograr a cabalidad su cometido.

  An essential condition for the single digital market to function in the European Union is incentivizing cross-border electronic commerce while, at the same time, providing the maximum possible protection for companies and particularly European citizens, who are the most vulnerable party in this type of transactions and, therefore, require greater protection and security. For this reason, as part of its stra-tegy to achieve this goal, the European Commission created the European Online Dispute Resolution Platform. In view of the significance of this initiative, not only at a regional level but for the world in ge-neral, this article conducts a critical analysis of the platform throughout its first few years in operation in order to determine its strengths and opportunities for improvement, thereby enabling us to identify where it should focus its efforts to fulfil its mission completely and effectively.
