The contribution analyses the perimeter of the control over the reasonig carried out by the Court of Cassation addressing the recurring questions about the role of the Court of Legitimacy in relation to the assessment of the fact. The Court, even within certain limits, is inevitably also a judge of the fact, especially when it is called to verify compliance with the rule of judgment of the beyond reasonable doubt

Il contributo analizza il perimetro del controllo sulla motivazione effettuato dalla Corte di cassazione, affrontando i ricorrenti interrogativi sul ruolo della Corte di legittimità rispetto alla valutazione del fatto. Si sostiene che la Corte, sia pure entro determinati limiti, è inevitabilmente anche giudice del fatto, soprattutto quando la medesima è chiamata a verificare il rispetto della regola di giudizio dell’oltre ogni ragionevole dubbio.
