In the wake of the Constitutional Court, the ruling of the United Section has redrawn guidelines for the renovation of the “trial” in case of a change, during the course of the proceedings, in the composition of the panel of judges. A decision full of shadows, guided by the necessity to make the duration of proceedings “reasonable”, that certainly will influence the future choice of the legislator in this matter.

Sull’onda della Corte costituzionale, con la pronuncia in esame, le Sezioni Unite hanno ridisegnato le linee guida della rinnovazione del “dibattimento” in caso di mutamento della persona fisica del giudice durante lo svolgimento del processo. Una decisione densa di ombre, orientata dalla necessità di rendere la durata del processo “ragionevole”, che certamente avrà un peso sulle future scelte del legislatore in materia
