    Toda persona que por su actuar ocasiona un daño a otro es, en principio, responsable de dicha conducta y deberá reparar el daño. El Estado como sujeto de derecho también resulta responsable, con ciertas particularidades. La responsabilidad del Estado por violación a los derechos humanos se vincula con su doble rol protector, ya que no debe promulgar normas que puedan llegar a restringir o destruir derechos fundamentales, como tampoco debe actuar en clara violación a los parámetros constitucionales. La Argentina ha pasado por dos períodos muy significativos: el de los Gobiernos de facto y el de los Gobiernos democráticos. En el segundo, se vio muchas veces un accionar arbitrario del Estado, pero con la diferencia de que se crearon normas que han indemnizado a las víctimas. Esta protección se ha ampliado a través de la incorporación de tratados internacionales sobre los derechos humanos.

    People who cause damage to others by their own acts are, in principle, liable for such conduct and must repair the damage they have caused. As a subject of law, the state is also liable, with certain peculiarities. The responsibility of the state for violation of human rights is linked to its double role as protector, since it must not enact rules that restrict or destroy fundamental rights, and neither can it act in clear violation of the constitutional parameters. Argentina has gone through two major periods in recent times: that of de facto governments and that of democratic governments. In the second of these periods, the state did often behave arbitrarily, but it differed from the previous period in that it created standards that have allowed victims to be compensated. This protection has been extended through the incorporation of international human rights treaties.
