Resumen de Multiculturalismo liberal e imigração: os limites da política da diferença

  The Contemporary States are characterized by a significant ethnic, racial and religious pluralism, which has been increasing in recent years due to migration phenomenon and the humanitarian refuge. This situation has led groups of migrants, refugees and marginalized nationals to direct demands for recognition, respect and promotion of their cultural uniqueness, imposing on the governments the unavoidable challenge to define the legal place of divergent manifestations, as well as the extent of political representation and self-government of these population groups. Although the policy of difference is opposed, in a way, to the liberal postulates that guide the contemporary states, demands for recognition will likely continue to occur. In this process, the International Human Rights Law constitutes an irreplaceable limit to divergent cultural expressions, especially concerning migration, immigration and refuges. In this study, the approach method is dialectical, and the research technique is literature. By way of concluding remarks, the partial, but progressive recognition has been, throughout the world, creating numerous recovery programs for enhancing cultural minorities, the institution of compensatory affirmative action, the allocation of autonomy, the self-government to certain groups, the consideration of their customs and traditions at the time of application of general laws, among other State measures.

  Os Estados contemporâneos caracterizamse por um acentuado pluralismo étnico, racial e religioso, o que vem se acentuando nos últimos anos, em razão do fenômeno da migração e do refúgio humanitário. Essa situação tem levado grupos de migrantes, refugiados e nacionais marginalizados a encaminhar demandas por reconhecimento, respeito e promoção de sua singularidade cultural, impondo aos governos o incontornável desafio de delimitar o espaço legítimo das manifestações divergentes, bem como da extensão da representação política e do autogoverno desses grupos populacionais. Apesar de a política da diferença contraporse, até certo ponto, aos postulados liberais que orientam os Estados contemporâneos, as demandas por reconhecimento provavelmente continuarão a ocorrer. Nesse processo, o Direito Internacional dos Direitos Humanos constitui um limite infranqueável às expressões culturais divergentes, principalmente no que se refere às migrações, imigrações e refúgios. Neste estudo, o método de abordagem é o dialético, e a técnica de pesquisa é a bibliográfica. A título de considerações finais, o reconhecimento parcial, mas progressivo, vem sendo, mundo afora, a criação de inúmeros programas de valorização das minorias culturais, a instituição de ações afirmativas compensatórias, a atribuição de autonomia, o autogoverno a certos grupos, a consideração de seus costumes e tradições no momento de aplicação de leis gerais, entre tantas outras medidas Estatais.
