Resumen de O Relatório da Comissão Nacional da Verdade: o capítulo sobre a atuação do Poder Judiciário durante a Ditadura civil-militar brasileira

  After two years of the publication of the National Truth Commission report, this work demon-strated that specifically the part about the operation of the Judiciary during the Brazilian civil-military dictatorship features systematizing nature, without representing an end to the investigation on truth and memory within the Brazilian transition. The text compared the National Truth Commission report to information found in primary sources, collected from the court files from Rio Grande do Sul State, in order to indicate inconsistencies and omissions of spaces of the Report dedicated to the judiciary. The work started from the premise that the effectiveness of transitional justice policies, aimed at consoli-dating democratic practices, is also subjected to authoritarian legacies that state institutions comprise. The analysis of the relations between the Judiciary and the exception could constitute a special area of observation of the relationship between Law and Politics. Faced with the inconsistencies presented by the Report on the functions of the Judiciary during the authoritarian period, the text concludes that its nature was merely systematizing, and the need for further research on the functions that the Brazilian judiciary has played in the context of authoritarian regime from 1964 to 1985 is undeniable.

  Após dois anos da publicação do Relatório Final da Comissão Nacional da Verdade, neste trabalho demonstrou-se que a parte a respeito da atuação do Poder Judiciário durante a Ditadura civil-militar brasileira apresenta natureza sistematizadora, sem representar um ponto final nas investigações sobre verdade e memória no âmbito da transição brasileira. Ao texto cotejou-se o Relatório da Comissão Nacional da Verdade (RCNV) com informações presentes em fontes primárias, colhidas dos arquivos judiciais do Estado do Rio Grande do Sul, a fim de indicar inconsistências e omissões dos espaços do Relatório dedicados ao Poder Judiciário. No trabalho partiu-se da premissa de que a efetividade de políticas de justiça de transição, voltadas à consolidação de práticas democráticas, está igualmente condicionada aos legados autoritários que as instituições do Estado comportam. A análise das relações estabelecidas entre o Judiciário e o poder autoritário constitui um espaço privilegiado de observação da relação entre Direito e Política. Diante das inconsistências apresentadas pelo Relatório, sobre as funções exercidas pelo Judiciário durante o período autoritário, no texto concluiu-se que sua natureza foi meramente sistematizadora, sendo indeclinável a necessidade de aprofundamento das pesquisas sobre as funções que o Judiciário brasileiro desempenhou no contexto do Regime autoritário de 1964-1985.
