Análisis jurídico del Anteproyecto de Ley del Deporte desde una perspectiva inclusiva y entre iguales

    Mediante el presente trabajo de investigación nuestro objetivo principal es analizar jurídicamente y, desde una perspectiva igualitaria y comparada, respecto de otros textos legales anteriores, cuáles son las novedades que incorpora el Anteproyecto de Ley del Deporte de febrero de 2019, el cual, aún no ha sido aprobado y que ha recibido numerosas objeciones a las propuestas de dicho texto inicial, tal y como tendremos ocasión de examinar. Por lo que, partiremos de la necesaria reforma de la Ley 10/1990, de 15 de octubre, del Deporte para precisamente alcanzar la pretendida igualdad efectiva, que debe ser entendida como igualdad de acceso a la práctica deportiva y a los puestos de carácter técnico y/o directivo dado el papel que hoy tienen las mujeres en las distintas disciplinas deportivas, así como la promoción del deporte inclusivo y ejercitado por personas con discapacidad. Finalmente, mostraremos cómo el articulado de dicho Anteproyecto, a diferencia del anterior, sí contiene el derecho a la igualdad en numerosos preceptos, las políticas y acciones concretas que prevé, así como los mecanismos que establece para conseguir una igualdad real, efectiva y sin discriminaciones de ningún tipo en materia deportiva.

    Through this research work, our main objective is to analyze legally and, from an equal and comparative perspective, with respect to other previous legal texts, what are the novelties that the Draft Bill of Sport of February 2019 incorporates, which, not yet It has been approved and has received numerous objections to the proposals of that initial text, as we will have occasion to examine. Therefore, we will start from the necessary reform of Law 10/1990, of October 15, on Sport to precisely achieve the intended effective equality, which should be understood as equal access to sports and technical positions and / or manager given the role that women today have in different sports disciplines, as well as the promotion of inclusive sport and exercised by people with disabilities. Finally, we will show how the articulation of said Draft, unlike the previous one, does contain the right to equality in numerous precepts, the specific policies and actions that it foresees, as well as the mechanisms that it establishes to achieve real, effective and non-discriminatory equality of any kind in sports.
