Resumen de Hacia la implantación de la inteligencia artificial en nuestro sistema judicial: Towards the implementation of artificial intelligence in our judicial system

  El presente artículo analiza la necesidad de la progresiva implantación de nuestro sistema judicial a las herramientas de inteligencia artificial y “Legaltech” que países como Estados Unidos o Argentina están aplicando en el ámbito judicial desde hace años. El uso de la tecnología más avanzada no sólo conlleva una gran inversión económica, sino que debe estar precedida por un análisis exhaustivo de su repercusión e implantación y por la elaboración de proyectos normativos que aseguren el respeto a los derechos fundamentales y a la Constitución Española. Sin embargo, esta materia tiene una relevancia internacional, y no cabe tan solo establecer una normativa nacional, sino que es fundamental la regulación a otros niveles supranacionales como la intervención de la Unión Europea que ya estudia los límites éticos y la injerencia del uso de las herramientas de inteligencia artificial en los derechos fundamentales.

  This article analyzes the need for the progressive implementation of our judicial system to the artificial intelligence and “Legaltech” tools that countries such as the United States or Argentina have been applying in the judicial field for years. The use of the most advanced technology not only implies a large economic investment, but must be preceded by an exhaustive analysis of its impact and implementation and by the elaboration of normative projects that ensure respect for fundamental rights and the Spanish Constitution. However, this matter has an international relevance, and it is not only possible to establish a national regulation, but it is essential to regulate at other supranational levels such as the intervention of the European Union that already studies ethical limits and the injection of the use of artificial intelligence tools in fundamental rights.
