    El presente artículo tiene por objeto el análisis de algunos problemas fundamentales que se han planteado, en sede judicial, en relación con la evaluación de los riesgos durante el período de lactancia natural a efectos de causar derecho a la prestación de seguridad social prevista para la protección de dicha contingencia. Concretamente, el análisis se centrará en aspectos como la necesidad de efectuar una evaluación específica, a quién corresponde la carga de la prueba de que la evaluación se ha realizado correctamente y, por último, la incidencia que pueden tener determinadas condiciones de trabajo como la turnicidad y nocturnidad de cara al reconocimiento de la prestación. Dicho análisis se afrontará teniendo en cuenta la evolución jurisprudencial experimentada por nuestro Tribunal Supremo y la repercusión que en ella han tenido algunos pronunciamientos concretos del Tribunal de Justicia de la Unión Europea.

    The purpose of this article is to analyze some of the main problems that have arisen in the courts in relation to the assesment of risks during the breastfeeding period. This assesement is required in order to obtain the Social Security benefits that cover the contingency of risks during the breastfeeding period. Specifically, the analysis will focus on issues such as the need to carry out a specific risk assesment, which party is responsible for the burden of proving that this assesment has been carried out correctly and, finally, the impact that certain working conditions such as work shifts and night work can have on the recognition of the benefits. This analysis will take into account the jurisprudential evolution experienced by our Supreme Court and the implications that some specific pronouncements of the Court of Justice of the European Union have had on it.
