La videovigilancia encubierta en la nueva regulación sobre derechos digitales laborales y la incidencia de la STEDH López Ribalda II

    En el presente estudio se analiza si la Ley Orgánica de Protección de Datos Personales y Garantía de los Derechos Digitales ampara la denominada videovigilancia encubierta, ya que en la misma no se hace mención expresa de este específico sistema de control laboral, que tiene por finalidad probar un incumplimiento laboral. Para ello se llevan a cabo previamente ciertas consideraciones sobre la regulación de la videovigilancia en dicha norma. A continuación, se repasa la doctrina constitucional sobre la videovigilancia encubierta y las resoluciones del Tribunal Europeo de Derechos Humanos, las sentencias ya conocidas como López Ribalda I y II. Ello permitirá determinar si la videovigilancia encubierta tiene encaje en el art. 89 LOPDPGDD.

    The present study analyzes whether the Personal Data Protection and Digital Rights Guarantee Act protects the so-called covert video surveillance, since that Act does not mention this specific system of labour control that it is intended to prove a breach of the labour contract. This requires stating in advance certain considerations on the video surveillance regulation. Then the constitutional doctrine and the ECHR resolutions, alreadyknow as López Ribalda I and II, are outlined. This should lead to a proper assessment of whether covert video surveillance is included in article 89 of the Personal Data Protection and Digital Rights Guarantee Act.
