    La presente investigación analiza el tratamiento jurídico de la prostitución y su forma de castigo cuando es practicada coercitivamente. Jurídico-penalmente, se discute si hay que ampliar el campo de potenciales autores que, de algún modo, obtienen beneficios de la prostitución: bien económicos, bien sexuales. Entre los primeros se encuentran, por un lado, los proxenetas no coercitivos, básicamente, los dueños de burdeles y clubs de alterne y los rufianes, y, por el otro, quienes ejercen la prostitución. Entre los segundos se hallan los clientes. Este artículo mira los diferentes modelos que hablan del castigo a esta práctica y expone sus características, y luego pasa a desarrollar su objetivo central que analizar la legitimidad de dichos modelos desde una perspectiva penal, lo que implica indagar sobre el fundamento del castigo de las conductas cuya criminalización se defiende.

    The present investigation analyzes the legal treatment of prostitution and its form of punishment when it is done coercively. From a Criminal Law perspective, there is some debate on whether it is necessary to expand the field of potential authors who, in some way, obtain economic or social benefits from prostitution:. Among the first are, on the one hand, the noncoercive pimps, basically, the owners of brothels and hostess clubs and ruffians, and, on the other hand, those who practice prostitution. Among the second are the customers. This article looks at the different models that speak of the punishment of this practice and exposes its characteristics, and then goes on to develop its central objective that to analyze the legitimacy of such models from a criminal perspective, which implies to investigate the basis of the punishment of the behaviors whose criminalization is defended.
