Resumen de Peculiaridades del registro de los derechos de autor: su relación con el requisito de la originalidad

  La protección automática de la obra y el consecuente reconocimiento de los derechos de autor no está en contradicción con la seguridad jurídica que brinda la actividad registral. Los actuales sistemas de protección de la creación precisan encontrar un fundamento a dicha relación, en la cual desempeña un rol esencial el criterio de la originalidad. Resulta imposible hablar de registro en derechos de autor si no se aborda desde la óptica de la originalidad y su especial relación. El presente artículo tiene como objetivo analizar las particularidades que existen en el registro de los derechos de autor a partir de la relación entre originalidad y actividad registral El trabajo se divide en tres partes: la primera está dirigida a explicar las particularidades del registro de los derechos de autor con especial referencia a la así como las excepciones que existen en materia de publicidad, y finalmente se trata la relación que existe entre la originalidad como requisito de protección de las obras y el registro. Como principal resultado podemos mencionar la fundamentación de las principales peculiaridades que existen en el registro de los derechos de autor a partir de la relación entre esta actividad y el criterio de la originalidad.

  The automatic protection of the work and the consequent recognition of copyright does not contradict the legal security provided by the registry activity. The current protection systems of creation need to find a foundation to this relationship in which the criterion of originality plays an essential role. It is impossible to speak of copyright registration unless it is approached from the perspective of originality and its special relationship. The objective of this article is to analyze the particularities that exist in the registration of copyright based on the relationship between originality and the registry activity. The work has been divided into three parts: the first is aimed at explaining the particularities of the copyright registration with special reference to the work as an object of registration; subsequently, the effects of the registry are discussed, as well as the exceptions that exist in the matter of publicity, and finally, the relationship that exists between originality as a requirement for the protection of works and registration are discussed. As the main result we can mention the foundation of the main peculiarities that exist in the registration of copyright based on the relationship between this activity and the criterion of originality.
