Bolivia y Chile ante la CIJ: punto final a la judicialización del reclamo marítimo

    El 24 de abril de 2013 Bolivia presentó una demanda versus Chile ante la Corte Internacional de Justicia (CIJ) reclamando la falta de cumplimiento por parte de su vecino de negociar una salida soberana al Océano Pacífico. A diferencia de otros momentos de la relación bilateral, el objeto del reclamo no consistió en denunciar el Tratado de 1904, sino que el foco estuvo puesto en la presencia de un sinnúmero de hechos que darían cuenta de la existencia de dicha obligación entre las partes. Luego de atravesar las fases escritas y orales establecidas por reglamento, el tribunal internacional desestimó, el 1º de octubre de 2018, la demanda boliviana, poniendo así punto final al abordaje jurídico del conflicto. En este artículo, se identifican los ejes centrales que atraviesan transversalmente las posturas de Bolivia y Chile, como demandante y demandado, respectivamente, para luego, reflexionar sobre el futuro de este vínculo tan complejo y particular.

    On April 24, 2013 Bolivia filed a lawsuit versus Chile in the International Court of Justice (ICJ) claiming the lack of compliance to negotiate a sovereign exit to the Pacific Ocean. Unlike other moments of the bilateral relationship, the object of the claim was not a request of revision or annulment of the 1904 Treaty, but rather the focus was on the presence of different facts that would prove the existence of this obligation between the parts. After going through the written and oral phases established by regulation, the International Court dismissed, on October 1 2018, the bolivian lawsuit, ending the legal approach to the conflict. This article identifies the principal topics across Bolivia and Chile´s positions during the trial and then reflects on the future of this complex and particular relation.
