El estudio aborda la problemática que plantea la adaptación del vencimiento anticipado a la Directiva sobre cláusulas abusivas en los contratos celebrados con consumidores. Esta problemática se desencadenó a partir de la Sentencia del Tribunal de Justicia de 14 de marzo de 2013 (asunto Aziz); pervive con la regulación actual en sede de ejecución hipotecaria, y está llamada a concluir si, finalmente, ve la luz el Proyecto de Ley reguladora de los contratos de crédito inmobiliario. El estudio da cuenta de la inseguridad jurídica que marca la situación actual, de las cuestiones prejudiciales pendientes y de las nuevas bases del régimen futuro del vencimiento anticipado.
The study addresses the problems posed by the adaptation of the early expiration date to the Directive on unfair terms in consumer contracts. This problem was triggered by the Judgment of the Court of Justice of March 14, 2013 (Aziz case). It remains in the current regulation on the foreclosure process, although is doomed to disappear if, finally, the Draft Law regulating real estate credit contracts is approved. The study shows either, the legal uncertainty that marks the current situation, the questions referred for a preliminary ruling and the newbases of the future regulation of early expiration date.
