La jurisprudencia del Tribunal de Justicia de la Unión Europeo ha activado la labor ex officio del juez nacional en algunas materias, tales como el conocimiento de cláusulas abusivas, lo que, en opinión de la doctrina, ha puesto en cuestión el principio dispositivo. Tras un examen histórico y teleológico de dicho principio se deduce que el Tribunal de Justicia no sólo no ha vulnerado el principio dispositivo, sino que lo ha resituado en sus justos términos.

The Court of Justice of the European Union’s case law has triggered the ex officio task of the national judge in some matters, such as unfair terms. Some authors think that this case law infringes the disposition principle. After a historical and teleological examination of that principle it can be concluded that the Court of Justice has not infringed such principle, but rather has relocated it in its correct terms.
