El trabajo analiza, a la luz del Derecho español y de la jurisprudencia del TJUE, hasta dónde se extiende el enjuiciamiento del juez cuando, en aplicación del principio de efectividad, se ha de pronunciar sobre cuestiones no pedidas por las partes. Asimismo, se examinan el modo de proceder y los efectos de la resolución (cosa juzgada y preclusión) según el proceso que se siga y la fase en que se encuentre. Por último, se aborda la cuestión de qué reacción procede en los casos de infracciones del Derecho de la Unión por resoluciones firmes.
In the light of the Spanish Law and the jurisprudence of the EUCJ, this paper analyzes the extent to which the judge must decide when, in application of the principle of effectiveness, she has to address issues that were not referred to by the parties. Likewise, the ways of proceeding and the effects of the decision are examined in connection with the type of process and the phase it is at (a particular attention is being paid to “res judicata” and preclusion).The question on how to proceed in cases of final judgements Union Law infringements is also addressed.
