En la presente comunicación se reflexiona sobre el concepto de mediación y lo que significa que este medio de gestión de conflictos sea voluntario, poniendo el acento en el alcance que el legislador comunitario europeo concede a este rasgo esencial de la misma. Asimismo, se razona sobre si sería contrario a nuestro ordenamiento jurídico que el legislador español dispusiera que es preciso intentar alcanzar un acuerdo, a través de una mediación, antes de ejercitar acciones ante la jurisdicción. Por último, dando por supuesto que no lo sería si se respetan determinadas cautelas, se formulan algunas sugerencias para que semejante exigencia pudiese ser eficaz, al menos, en algunos supuestos.
This communication presents some reflections on the concept of mediation and what is the significance of the voluntary character of such an instrument for conflict management, with emphasis on the scope granted to this essential feature by the European Community legislator. In addition, it is discussed whether it would be contrary to our legal system that the Spanish legislator decides it is necessary trying to reach an agreement, through a mediation process, prior to bring actions before the courts. Finally, assuming that it would not be contrary to our legal system if certain precautions are respected, some suggestions are presented that will allow such a requirement could be effective, at least in some cases.
