    El objetivo de este trabajo es exponer el tránsito realizado por la normativa de aguas en Chile, desde la consideración del recurso hídrico como un activo estatal, público, y perteneciente a todos los habitantes de la nación. Por consecuencia:

    garantizar su acceso, distribución y equilibrada gestión; a ser una mercancía como una casa o un automóvil, a merced de las variaciones de la oferta y la demanda. El presente artículo se estructura en cinco acápites, los cuales abordan diversos tópicos que son relevantes para comprender la normativa actual vigente y las problemáticas que a través de ellas se generan. Se busca comprender el funcionamiento la institucionalidad chilena y su tratamiento de un recurso estratégico como el agua bajo las reglas del mercado; los problemas que esta política estatal genera y cómo afectan la producción, los derechos de la población y el medioambiente; los procesos históricos, sociales, y culturales que llevaron a que en Chile se adoptase ese modelo de gestión del recurso hídrico y proponer eventuales soluciones, medidas y estrategias que permitan a futuro, mejorar y garantizar el agua como un derecho humano y no como un producto.

    The aim of study is to expose the transition carried out by the water regulations in Chile, from the consideration of the water as a state’s resource, public asset, and belonging to all the inhabitants of the nation. By consequence: guarantee its access, distribution and balanced management; to be a commodity like a house or a car, at the mercy of the variations of supply and demand. This article is structured in five sections, which address various topics that are relevant to understand the current regulations in force and the problems that are generated through them. It seeks to understand the functioning of Chilean institutions and their treatment of a strategic resource such as water under the rules of the market;

    the problems that this state policy generates and how they affect production, the rights of the population and the environment; the historical, social and cultural processes that led to the adoption of this model of water resource management in Chile and propose possible solutions, measures and strategies that allow the future to improve and guarantee water as a human right and not as a product.
