    El legislador, a través de la acción directa recogida en la disposición adicional 6. ª de la Ley 9/2013, confiere al porteador efectivo subcontratado un instrumento que le permite intimar de pago, no solo a quien le subcontrata, sino también al cargador inicial y a subcontratistas anteriores en la cadena de transporte. Se trata de una acción de naturaleza imperativa, pero también caracterizada por ser inmune frente al pago realizado por el cargador inicial. Los problemas de índole procesal que el ejercicio de esta acción genera no han sido tratados de forma unánime por nuestros tribunales creando peligrosas situaciones de incertidumbre. Además, las más recientes resoluciones judiciales han resuelto algunos aspectos de forma que pueden llevar a la inoperatividad de la acción.

    Lawgiver in Spain, through the direct action provided for in the Sixth Additional Provision of Spanish Act 9/2013, gives to outsourced actual carrier an instrument that allows him to claim for payment , not only against the outsourcer, but also against the initial shipper and previous outsourcers in the transport chain. The legal nature of this action is compulsory, but another important feature of it is its immunity from the payment made by the initial shipper. Procedure issues to which gives rise the exercise of this action have not been unanimously considered by our Courts, and that is why there are some dangerous situations of legal uncertainty as result of this Case Law. In addition, the most recent judgments have ruled certain matters of form in a way that may lead to the inoperability of the action.
