    En el presente trabajo se analiza la Sentencia del Tribunal de Justica de la Unión Europea de 11 de diciembre de 2014 y consecuente modificación operada por el Real Decreto-ley 8/2017 en el régimen de estiba y desestiba y su significado en la dialéctica entre las libertades económicas comunitarias y la protección de los trabajadores. A tal fin, se aborda el examen de la regulación en clave de principio de proporcionalidad y las circunstancias que inciden en la descompensación a favor de las libertades. Finalmente, se esbozan algunas perspectivas de futuro.

    In the present work the Judgment of the Court of Justice of the European Union of December 11, 2014 and consequent modification operated by Real Decreto-ley 8/2017 in the stevedoring and unloading regime and its meaning in the dialectic between the community economic freedoms and the protection of workers is analyzed. To this end, the regulation in the key of principle of proportionality and the circumstances that affect the decompensation in favor of freedoms is analyzed. Finally, some future perspectives are outlined.
