The essay deals with the use of the category of res communes omnium in the field of cosmic space law, starting from a recent article by Andrea Capurso, winner of the Diederiks-Verschoor Award for international space law. It traces in the first place the salient points of the author’s thought, and in particular the configuration that he connects to the res communes omnium in ancient Rome, founding it on the binomial ‘container-contained’. On this basis, the contribution proceeds to verify whether this dichotomy can actually be found in the sources, also in the light of the reconstruction of the regime of the res communes omnium and of aer in Roman law, reaching a tendentially negative conclusion. Finally, it formulates a possible alternative proposal for the ‘reuse’ of Roman categories in the field of cosmic space law, underlining some points worthy of further reflection, concerning the remedial side of the question and the problem of the application to States of the category of the res communes omnium, conceived in the Roman experience for individuals.
