l propósito de este trabajo consiste en realizar un estudio sobre la inclusión de bienes privativos de uno o ambos cónyuges en el convenio regulador de la nulidad, separación o divorcio y su posible inscripción en el Registro de la Propiedad. En este sentido, se analizará la doctrina de la Dirección General de los Registros y del Notariado que determina la necesaria conexión que debe existir entre la causa y el principio de titulación auténtica que exige el artículo 3 de la Ley Hipotecaria. Con posterioridad, examinaremos si la inclusión de de bienes privativos cumple los requisitos esenciales de consentimiento, objeto y causa de todo negocio jurídico de manera que permita su inscripción. Finalmente, se atenderá la posibilidad de incluir supuestos de inclusión de bienes privativos en el convenio regulador no admitidos por la Dirección General de los Registros y del Notariado.
The purpose of this work is to carry out a study on the inclusion of private property of one or both spouses in the nullity, separation or divorce regulatory agreement and its possible registration in the Property Registry. In this sense, the doctrine of the General Directorate of Registries and Notaries that determines the necessary connection that must exist between the cause and the principle of authentic title required by Article 3 of the Mortgage Law will be analyzed. Subsequently, we will examine whether the inclusion of private property meets the essential requirements of consent, purpose and cause of any legal business in a way that allows its registration. Finally, the possibility of including the inclusion of private assets in the regulatory agreement not admitted by the General Directorate of Registries and Notaries will be addressed.
