La declaración de la muerte y los sujetos llamados a delación respecto a un causante constituye un juicio notorio que ofrece el Notario en el título sucesorio abintestato. Razón por la que ha de ser considerada como acta de notoriedad y por ende, de jurisdicción voluntaria. Juicio que solo le compete rectificar a este funcionario aun cuando los llamados en la rectificación pertenezcan a un orden preferente a los ya declarados.

The statement of the death and the subjects called to delation concern to a causer constitutes a notorious judgment that the notary offers in the intestate succession title. Reason why it has to be considerate as notoriety act and consequently, of voluntary jurisdiction. Judgment that only concern rectify to this functionary, even when the ones called in the rectification belong to a preferable order to the already declared.
