La deuda por obligación constituida a través de crédito con aval del estado no constituye excepción al discharge en el ordenamiento jurídico chileno

    Resumen Con base en un estudio dogmático de los fundamentos y justificaciones del fresh start y las excepciones al discharge, y tras un análisis crítico de la sentencia de la Corte Suprema, rol n.° 4656-2017, de 9 de mayo de 2017, que excluye del ámbito de aplicación del discharge de la ley n.° 20720 a todas las deudas de obligaciones contraídas a través de créditos con aval del estado, proponemos un criterio que, comprendiendo una correcta interpretación y consecuente armonización de las normas, otorga certeza jurídica a los deudores y soluciona el problema de relevancia jurídico social que el razonamiento de la Corte conlleva.

    Abstract Based on a dogmatic study of the fundamentals and justifications of the fresh start and the exemptions to the discharge, and after a critical analysis of the judgment of the Supreme Court, n.° 4656-2017, of May 5, 2017, that excludes from the scope of application of the discharge of Act 20.720 to all debts arising from breach of obligations contracted through credits with the state guarantee, we propose a criterion that, comprising a correct interpretation and consequent harmonization of the norms, grants legal certainty to the debtors and solves the problem of social legal relevance that the reasoning of the Court entails.
