  En las últimas décadas, mucho se escribió -y cada vez más- sobre acceso a justicia y protección de derechos humanos. Del mismo modo, para no quedar en solo teorías, muchas legislaciones se adecuan a nuevas olas de necesidades sociales que, con el correr del tiempo, se visualizan. Siguiendo con esta línea, los Estados de derecho instrumentan mecanismos tendientes a garantizar su efectiva puesta en práctica. Un caso particular es el campo de la Salud Mental. En él, se vive un profundo cambio de paradigma, poniendo en duda la adecuación de algunos conceptos y la efectividad de ciertas prácticas. Sin embargo, no toda legislación moderna sigue esa misma dirección. Un ejemplo de ello es el proyecto de ley de salud mental de Baviera del año 2018. En él se observan disposiciones que colisionan con preceptos universales en materia de derechos humanos.

    Over the last decades, there have been numerous works—and increasingly so—about access to justice and the protection of human rights. In the same way, in order to go beyond more theories, many statutes adapt to new waves of social needs, which are identified in the course of time. Following this trend, states provide mechanisms to ensure their effective implementation. One particular case is the field of mental health. There is a profound change of paradigm in it, questioning the adequacy of some concepts and the effectiveness of certain practices. However, not all modern legislation follows that same direction. An example of this is the bavarian mental health law project of the year 2018, which shows provisions that collide with universal human rights precepts.
