    La historia clínica es un documento médico legal de importancia en la labor asistencial, y está reconocida como una relación médico-paciente. Objetivo: determinar el valor médico legal de la historia clínica e implicaciones legales del ejercicio de la medicina. Método: enfoque cualitativo, tipo de investigación exploratoria, diseño no experimental, de campo. La muestra estuvo conformada por tres profesionales especialistas en el área. Para la recolección de datos se utilizó una entrevista semi-estructurada, posteriormente se generó una discusión con sentencias legales. Resultados: la responsabilidad médica en la historia clínica, desde el punto de vista ético y legal, es del médico, él es responsable de todo lo que transcribe en ella. Indudablemente, la historia clínica en un juicio es un medio de prueba por excelencia. Conclusiones: El derecho y la ética del acto médico en cualquier momento se cruzan, la autoridad judicial tiene clara su actuación legal en la documentación médico-legal de la historia clínica, es por ello que el médico debe realizar la historia con la normativa correspondiente, que en ella debe reposar.

    The medical history is a legal medical document of importance in the care work, and is recognized as a doctor-patient relationship. Objective: to determine the legal medical value of the medical history and its legal implications of the practice of medicine. Method: qualitative approach, type of research exploratory, non-experimental, field design. The sample consisted of three professionals specialized in the area. For the data collection, a semi-structured interview was used, later a discussion was generated with legal sentences. Results: the medical responsibility in the medical history, from the ethical and legal point of view, belongs to the doctor, he is responsible for everything that transcribes in it. Undoubtedly, the clinical history in a trial is a means of proof by excellence. Conclusions: The law and ethics of the medical act at any time intersect, the judicial authority has clear legal action in the medical-legal documentation of the medical record, that is why the doctor must make the history with the corresponding regulations, that in it must rest.
