Cuando se origina un incidente se pueden generar diferente tipo de daños, entre estos, los denominados tradicionales que abarcan daños patrimoniales o personales, los cuales son considerados como cuasidelitos que afectan directamente el patrimonio de un individuo y para su reparación se aplica la responsabilidad civil extracontractual subjetiva. Sin embargo, también se generan otro tipo de daños que no afectan directamente al patrimonio de una persona, sino a bienes de interés colectivo y general, como lo es el medioambiente y sus elementos, en cuyo caso, se genera un daño ambiental o ecológico, cuya reparación se la realiza por medio de la responsabilidad ambiental, que se caracteriza por tener un régimen especial y diferente, pero principalmente por ser objetiva, debido a que más allá de los riesgos que pueda significar una actividad que implique afectaciones al medioambiente, su obligación nuclear se centra en la prevención y evitación del daño ambiental, por lo que, cuando el deterioro surge, conlleva de manera implícita la premisa de que se ha incumplido deber de prevenir y evitar el daño.

When an incident happens, different types of damages can be generated, among these, the so-called traditional ones that include patrimonial or personal damages, which are considered as cuasidelitos and affects directly to the patrimony of an individual and for its repair the subjective extracontractual civil liability is applied. However, other types of damage are also generated that do not affect directly the assets of a person, but rather to assets of collective and general interest, such as the environment and it´s elements, in which case, environmental or ecological damage is generated, whose reparation is carried out through environmental liability, which is characterized by having a special and different regime, but mainly because it is objective, beyond the risks that an activity involves the environment may entail, it´s nuclear obligation focuses on the prevention and avoidance of environmental damage, so when the deterioration arises, implicitly involves the premise that it has breached duty to prevent and avoid harm.
