    • English

The jurisprudence and doctrine of the Constitutional Court are in favor of the correction of procedural budgets, including the power of procedural representation, in order to safeguard the right to effective judicial protection. Although they formally distinguish the vices in which the power of the attorney may incur, they materially offer unitary treatment, making the pro-action principle prevail over the principle of legality.
