  Los sistemas marcarios europeo (en 2016 y 2017) y nacional (en 2018) han sufrido reformas de calado que afectan también a la obligación de uso, pese a que las regulaciones ya estaban en gran medida homogeneizadas. El presente trabajo pretende ofrecer, a partir de las sentencias del Tribunal de Justicia de la Unión Europea y del Tribunal Supremo español un estudio conjunto del estado actual de la obligación de uso en el Reglamento sobre la Marca de la Unión Europea y en la Ley de Marcas, señalando aquellos aspectos en los que han incidido las reformas normativas.

  The European (in 2016 and 2017) and national (in 2018) trademark systems have suffered draft reforms that also affect the use obligation, despite the fact that the regulations were already largely homogenized. The present work intends to offer, based on the judgments of the Court of Justice of the European Union and the Spanish Supreme Court, a joint study of the current status of the trade mark use obligation in the European Union Trademark Regulation and in the Trademark Law, pointing out those aspects in which the regulatory reforms have affected.
