Nuevas teorías de la intencionalidad; su aplicación a la simulación matrimonial

    La comprensión de las teorías de la intencionalidad resulta fundamental a la hora de distinguir un acto positivo de la voluntad excluyente y simulatorio respecto de otras variables intencionales que no harían nulo el matrimonio tanto en el ámbito canónico como en el ámbito civil. En el presente artículo aplicamos dos teorías de la intencionalidad contemporáneas que concretan y actualizan las propias de Santo Tomás y de la escolástica posterior al consentimiento matrimonial y a la simulación del mismo. Se trata de la teoría del acto realizativo de J.L Austín y la del acto intencional de Searle. En el ámbito canónico estas teorías permiten prescindir de precisiones jurisprudenciales bastante complejas de comprobar y distinguir mejor el acto positivo de la voluntad respecto de motivaciones, mentalidades y voluntades genéricas que no harían nulo el matrimonio. En el ordenamiento civil, partimos de la premisa de no regular en el fuero interno de la persona y constatamos como la praxis ha relegado este principio. Desde esta constatación se evidencia la aplicabilidad de las teorías de la intencionalidad al ámbito de la simulación del consentimiento matrimonial civil.

    The understanding of the theories of intentionality is fundamental when it comes to distinguishing a positive act from the exclusionary and simulatory of matrimonial consensus will with respect to other intentional variables that would not nullify marriage, both in the canonical sphere and in the civil sphere. In the present article we apply two theories of contemporary intentionality that concretize and update those of St. Thomas and of scholasticism after matrimonial consent and the simulation of it. It is about the theory of the realizing act of J.L Austin and that of the intentional act of Searle. In the canonical sphere, these theories allow us to dispense with rather complex jurisprudential precisions of checking and distinguishing better the positive act of the will respect to: motivations, mentalities and generic wills that would not nullify the marriage. In the civil jurisdiction, we start with the premise that the civil laws not entering the internal forum and how praxis has relegated this principle. From this observation the applicability of the theories of intentionality is more fully demonstrated.
