It is common in Brazil to see the rights of LGBTQI + people to be ignored socially and institutionally. Despite the state initia-tives aimed at LGBTQI+ tutelage, their ineffectiveness is noto-rious, since discourses of hatred and criminal acts are frequent.
Using the socioanalytical method and the deductive approach, the text analyzes how the public power has dealt with this aspect in the context of sexual rights. In discussing the three-dimensional theory of law, it discusses the LGBTQI+phobia, addresses convergences between racial, gender and sexual movements and analyzes the state’s action in the face of the dispute over the recognition of gender identity and sexual orientation. It maintains at the end that mere penalizing law is insufficient to enforce anti-discriminatory rights and thus reflects on ways to effectively make constitutional principles and human rights effective.

É comum no Brasil ver os direitos de pessoas LGBTQI+ serem ignorados de forma social e institucional. Apesar das iniciativas estatais voltadas à tutela LGBTQI+, é notória a ineficácia destas, uma vez que discursos de ódio e atos criminosos são frequentes. Utilizando-se do método socioanalítico e da abordagem dedutiva, o texto analisa como o poder público tem tratado deste aspecto no contexto de direitos sexuais. Ao dialogar com a Teoria Tridimensional do Direito, discute a LGBTQI+fobia, aborda convergências entre os movimentos racial, de gênero e sexual e analisa a atuação estatal face à disputa pelo reconhecimento da identidade de gênero e orientação sexual. Sustenta ao final que a mera lei penalizadora é insuficiente para efetivar direitos antidiscriminatórios e, assim, reflete sobre meios para tornar eficaz, de fato, princípios constitucionais e direitos humanos.
