Los tipos de democracia a la luz de la Roma republicana

    En un análisis comparativo entre el mundo romano y la actualidad en España, este trabajo pretende establecer una eventual sintonía entre la labor de las Asambleas Comiciales, con el “refrendo” del Senado, y nuestras dos cámaras legislativas: el Congreso y el Senado. Se trata, por una parte, de analizar la posible correspondencia en el modo de proceder de Roma y el actual, así como de extraer las naturales diferencias, derivadas de dos sociedades abiertamente distintas. No todo es extrapolable entre dos mundos anacrónicamente distantes; pero sí parece posible el estudio de la democracia en la actualidad, partiendo de los postulados, premisas y fundamentos, que se remontan a la época romana, principalmente de la época republicana. La diferencia entre democracia participativa y democracia representativa tiene también una razón de ser en ambos tipos de sociedad, y en las posibilidades abiertas en una y otra. A todo ello cabe añadir la evidente semejanza entre el Senado romano y el Consejo de Estado que actúa como “consejo del reino” en nuestro ordenamiento jurídico-político positivo.

    In a comparative analysis between the Roman world and today in Spain, this work aims to establish a possible harmony between the work of the Assemblies comitial with the “endorsement” of the Senate, and our two legislative chambers: The Congress and Senate. This is, firstly, to analyze the possible mapping mode proceed Rome and current, and to extract the natural differences, derived from two different companies openly. Not everything is extrapolated between two anachronistically distant worlds; but it seems possible the study of democracy at present, based on the principles, assumptions and foundations that date back to Roman times, mainly from the Republican era. The difference between participatory democracy and representative democracy also has a “raison d’être” in both types of society, and open possibilities both. The obvious resemblance between the Roman Senate and the Council of State acting as “council of the kingdom” in our positive juridical-political order must be added.
