Litigación camiones: la Sentencia del TJUE Tibor- Trans y su repercusión en la determinación de la competencia judicial en los litigios que se susciten ante tribunales españoles

    Una de las cuestiones recurrentes en los litigios derivados del Cártel Camiones, en España y en el resto de Estados miembros, es la determinación de la competencia judicial internacional en aplicación del criterio de competencia previsto en el art. 7.2º del Reglamento UE 1215/12, «lugar dónde se ha producido el hecho dañoso». La STJUE Tibor-Trans interpreta dicho artículo como el lugar dónde se localiza el mercando afectado en el que se han falseado los precios y la víctima ha sufrido el daño. Previo a esta sentencia y lo largo del año 2019, el Tribunal Supremo ha ido dictando diversos autos sobre la misma cuestión. Estas resoluciones, que adolecen de un error técnico-jurídico inicial al negar que el foro del art. 7.2º del Reglamento 1215/12 actúa también como criterio de competencia territorial, se muestran contradictorias entre ellas. Es por todo ello que la STJUE Tibor-Trans incidirá en la determinación de la competencia judicial internacional del la, quizás, aún ingente cantidad de litigios Camiones que se planteen ante los tribunales españoles

    One recurring topic in the Truck Cartel Claims, in Spain and in the rest of the Member States, is the determination of international jurisdiction according to the rule laid down in Article 7.2º of Regulation EU 1215/12, «place where the harmful event occurred». The judgment Tibor-Trans interprets this article as the place where the market affected is located, that is to say, the place where the market prices were distorted and the victim has suffered the damage. Prior to this judgment and throughout the year 2019, the Spanish Supreme Court has issued several judgments on the same issue. These judgments, which suffer from an initial technical-legal error in denying that the rule of Article 7.2º Regulation 1215/12 also acts as a rule of territorial competence, are contradictory among them. That is why the judgment Tibor-Trans will influence the determination of the international competence of the, perhaps, still huge amount of Truck Cartel Claims to be brought before the Spanish courts
