    The paper examines the first internal jurisprudential implementations of the ne bis in idemprinciple, as outlined by the recent rulings of the Court of Justice and the Court of Strasbourg. Starting from the analysis of the interpretative evolution that has characterized the European approach to ne bis in idem, the paper focuses attention on the sanction proportionality test - centerpiece of the judgment of legitimacy of a system of "double track" sanctions -, highlighting the many uncertainties surround the issue and the significant application critical profiles of the test itself.

    Lo scritto esamina le prime applicazioni giurisprudenziali interne del principio del ne bis in idem, così come delineato dalle recenti pronunce della Corte di Giustizia e della Corte di Strasburgo. Muovendo dall’analisi dell’evoluzione interpretativa che ha caratterizzato l’approccio europeo al ne bis in idem, l’elaborato focalizza l’attenzione sul test di proporzionalità sanzionatoria – fulcro del giudizio di legittimità di un “doppio binario” punitivo –, evidenziandone le numerose incognite operative e i notevoli profili di criticità applicativa.
