Combatiendo al oponente en su terreno: dos tesis hobbesianas en torno a las relaciones entre la ley natural y la ley civil

    En defensa del carácter absoluto del poder soberano estatal, Hobbes elaboró una filosofía política y jurídica opuesta a la tradición del iusnaturalismo medieval y a su concepción del poder político como poder limitado por los poderes eclesiásticos. Lo extraordinario de este ataque al iusnaturalismo es que lo llevó a cabo manteniendo términos centrales del mismo. Esta estrategia genera tensiones bajo la superficie clara y sólida de su argumentación. Las dos tesis sobre las relaciones entre la ley natural y la ley civil que analiza este artículo son muestra de ello. Este análisis pretende aclarar algunos puntos de dichas relaciones en el pensamiento hobbesiano así como mostrar la evolución de este tema de una a otra de sus tres principales obras de filosofía política.

    In defence of the absolute character of state sovereign power, Hobbes elaborated a political and legal philosophy opposed to the tradition of medieval natural law and his conception of political power as limited by ecclesiastical powers. The extraordinary thing about this attack on natural law is that it was carried out keeping its central terms. This strategy generates tensions under the clear and solid surface of his argument. The two theses on the relationship between natural law and civil law analyzed in this article are a sample of this. The analysis of both theses aims to clarify some points of that relationship in hobbesian thought, as well as to show the evolution of this theme from one to the other of his three main works of political philosophy.
