La presente comunicación tiene como objetivo analizar, desde una perspectiva crítica, las condiciones legales previstas por el Derecho de Extranjería en España para que los extranjeros puedan adquirir la condición de autónomos. Para cumplir con el objetivo planteado se parte por analizar, desde una perspectiva general, las características del sistema. A continuación, se analizan brevemente los diferentes supuestos previstos para el acceso al trabajo por cuenta propia por parte de los extranjeros, tanto residentes como no residentes. Por último, se analizan las deficiencias que presenta el sistema y las condiciones de su aplicación. Todo ello para demostrar que existe una situación de discriminación “formal” compatible con el sistema legal, que dificulta el acceso de los extranjeros al régimen jurídico del trabajo autónomo.

The purpose of this communication is to analyze, from a critical perspective, the legal conditions provided by the Spanish Immigration Law to obtain the authorization to work as a self-employed for foreigners. In order to fulfill the proposed objective, we start by analyzing, from a general perspective, the characteristics of the system. The different scenarios foreseen for access to self-employment by foreigners, both residents and non-residents, are briefly analyzed below. Finally, the deficiencies presented by the system and the conditions of its application are analyzed. All this to demonstrate that there is a situation of "formal" discrimination compatible with the legal system, which hinders the access of foreigners to the legal regime of self-employment
