Protección de las comunidades étnicas en el sistema interamericano: Caso Riosucio – Chocó

    Esta investigación tiene como objetivo identificar los vacíos estatales derivados de la ausencia de mecanismos suficientes para una reparación efectiva de los habitantes afrodescendientes del municipio de Riosucio (Chocó), que han sido víctimas del conflicto armado.

    Para cumplir con el objetivo planteado, se procede mediante una metodología de análisis documental y jurisprudencial de sentencias de la Corte Interamericana de los Derechos Humanos y de la Corte Constitucional, así como informes estatales, reseñas testimoniales y fuentes secundarias. A partir de allí, se realiza un estudio de caso de la comunidad de la cuenca del Río Cacarica, en Riosucio (Chocó).

    El análisis de los documentos de estudio, testimonios y la jurisprudencia proferida al respecto a nivel nacional e internacional, permite establecer que el Estado, como principal protector de derechos fundamentales, ha faltado a los compromisos legales adquiridos respecto de la reparación a la comunidad desplazada de la cuenca del Río Cacarica, donde acontecieron operaciones militares contra la población civil, una de ellas denominada ‘Operación Génesis’.

    En definitiva, este artículo concluye que el Estado no cumple los compromisos relacionados con la reparación de víctimas y carece de instrumentos internos para garantizar una reparación satisfactoria y total de los afectados.

    The objective of the present investigation is to identify the state gaps, derived from the absence of sufficient mechanisms for an effective reparation, specifically of Afro-descendant inhabitants of the Municipality of Riosucio (Chocó) who have been victims of the armed conflict.

    The methodology applied corresponds to the documentary and jurisprudential analysis of judgments of the Inter-American Court of Human Rights and the Constitutional Court, state reports, testimonial testimonies and secondary sources; through them, a case study of the community of the Cacarica River basin, in Riosucio (Chocó), is conducted.

    The analysis of the study documents, testimonies and the jurisprudence proffered in this regard at national and international level, allows to establish, if the State, as the main protector of fundamental rights, has failed to comply with the legal commitments acquired regarding the reparation to the displaced community. Of the Cacarica River basin, where military operations against the civilian population took place, one of them called 'Operation Genesis'.

    Everything allows to conclude that the State does not fulfill the commitments related to the reparation of victims and lacks internal instruments to guarantee a satisfactory and total reparation of those affected.
