    En este trabajo realizamos un estudio comparativo del Código civil español con el italiano en relación al derecho de acrecer entre coherederos. Para ello, analizamos, en primer lugar, el concepto de derecho de acrecer, dependiendo de cómo lo ha configurado la doctrina, bien como un efecto, una facultad o un derecho. A continuación, analizamos el derecho de acrecer en la sucesión intestada, para pasar luego a analizarlo en la sucesión testada. Dentro de la sucesión testada estudiamos los requisitos para que tenga lugar el acrecimiento: llamamiento plural, llamamiento conjunto a una misma herencia o a una misma porción de ella, y que alguno de los llamados no suceda, analizando dentro de este último requisito los distintos supuestos de vacante. Estudiamos también si es posible el acrecimiento en la legítima, en la mejora y en el tercio de libre disposición. Finalmente analizamos los efectos que produce el acrecimiento.

    In this work we carried out a comparative study of the Spanish Civil Code with the Italian one in relation to the right to increase heritage between brothers. To this end, we first analyze the concept of the right to increase, depending on how the doctrine has configured it, either as an effect, a faculty or a right. Next, we analyze the right to increase in intestate succession, and then to analyze it in the testated succession. Within the testamentary estate succession we study the requirements for the accretion to take place: plural appeal, joint appeal to the same inheritance or to the same portion of it, and that some of the calls do not happen, analysing the different vacancy scenarios within the latter requirement. We also look at whether it is possible to accretion the level of legitimacy, improvement and free disposal. Finally, we analyze the effects that accretion produces.
