    The role of the French Administrative Judge to control decisions relating to environmental topics is to thoroughly verify the reasoning of the administration. It goes as far as to examine the cost-benefit balance of a project and may be led to modify, on its own initiative, the contested decision. However, the technical content of environmental law limits the extended competences of judges. How, then, improve the consideration of the environment by the judge? A way advocated in international bodies is to form specialized judges, or even develop environmentally specialized courts. However, it is possible in France to avoid using this approach – given the numerous drawbacks of it – based on the Environmental Authority created in 2009. Technical expertise is now readily available.

    L’office du juge administratif français dans le contrôle des décisions relatives à l’environnement est un contrôle exigeant qui va jusqu’à examiner le bilan coûts-avantages d’un projet et qui peut le conduire à modifier de sa propre initiative la décision attaquée. Cependant la technicité du droit de l’environnement a pour effet de limiter dans la pratique ces pouvoirs étendus. Comment alors améliorer la prise en compte de l’environnement par le juge ? Une voie préconisée dans les instances internationales est de spécialiser le juge, voire de développer des tribunaux spécialisés qui n’auraient à connaître que d’affaires liées au droit de l’environnement. Or, il est possible en France d’éviter de recourir à cette approche dont les inconvénients sont nombreux en s’appuyant sur le dispositif d’autorité environnementale développé depuis 2009. Une expertise technique est aujourd’hui aisément disponible.
