  The priority preliminary ruling on constitutionality enhanced the legal constitutional litigation, and therefore environmental law. This instrument, used in particular by the certified environmental protection associations, allowed to enhance the environmental associations’ legal action. France Nature Environnement stands out particularly from other environmental protection associations as it is more involved in the environmental constitutional litigation. The priority preliminary ruling on constitutionality appears to be a relevant legal instrument for the associations, as it is seems to be a good means to achieve the development of a constitutional case law. Throughout the study of FNE’s legal interventions, a real litigation strategy is being developed, therefore allowing the increase of the number of environmental cases brought before the supreme jurisdiction.

  La question prioritaire de constitutionnalité (QPC) est venue enrichir le contentieux constitutionnel et a fortiori le droit applicable à la protection de l’environnement. Ce moyen d’action, notamment utilisé par les associations agréées de protection de l’environnement, a permis de renforcer cette action associative en matière environnementale. France Nature Environnement (FNE) se distingue des autres associations de protection de l’environnement dans la mesure où elle est davantage impliquée dans le contentieux constitutionnel de l’environnement. La QPC apparaît alors comme un instrument juridique pertinent pour les associations qui tend au développement d’une jurisprudence constitutionnelle. À travers l’étude des interventions de FNE, une réelle stratégie contentieuse est construite, permettant ainsi d’accroitre le contentieux environnemental devant la juridiction suprême.
