O objetivo do artigo é recuperar parte do legado crítico de Lola Aniyar de Castro a fim de debater a seletividade do controle penal em relação aos crimes contra a humanidade. A metodologia de pesquisa foi a análise documental e bibliográfica, bem como o estudo de caso, focado no estudo de dois julgamentos do Supremo Tribunal Federal (STF). A nossa hipótese é que o STF do Brasil, no momento de ajuste de contas com o passado, ao apreciar a constitucionalidade da lei da Anistia, em abril de 2010, julgou a ADPF 153 e, ao avaliar a imprescritibilidade dos crimes de lesahumanidade (Extradição 1362), optou por interpretação restritiva quanto à investigação e julgamento de crimes contra a humanidade.
The objective of this article is to retrieve part of the critical legacy of Lola Aniyar de Castro in order to debate the selectivity of the penal control concerning crimes against humanity. The methodology is the documentary and bibliographical analysis and it is based on the case study of two sentences of the Brazilian Federal Supreme Court. Our hypothesis is that the Court, when faces the past, in the judgment of the Amnesty Act, in April 2010 and in the Extradition Proceeding 1362, adopted a restrictive interpretation and it did not permit the judgment of crimes against humanity.
