Resumen de Protección del derecho del titular de una marca posterior en los procesos por violación de marca (art. 41 bis LM): la restauración parcial de la inmunidad registral

El presente trabajo está dedicado al estudio del art. 41 bis de la Ley de Marcas, introducido tras su modificación por el Real Decreto-ley 23/2018, resultado de la trasposición de la Directiva UE 2015/2436. Dicho precepto viene a establecer un nuevo marco relacional entre el titular de una marca registrada anterior y el titular de una marca registrada posterior, cuando ambas marcas entran en conflicto. Su introducción obliga a hacer una revisión del alcance del ius utendi del titular de la marca registrada, que se ha venido traduciendo en la inmunidad registral ligada a la dimensión positiva del derecho exclusivo sobre la marca

The present paper deals with Art. 41 bis of the Spanish Trade Mark Act, that has been introduced after the amendment of this Act by the Royal Legislative Decree 23/2018 as a result of the transposition of the Directive EU 2015/2436. This provision sets a new relational framework between the proprietor of a prior registered trade mark and the proprietor of a later registered trade mark in the case of conflict among both trade marks. The introduction of such a provision requires to review the scope of the ius utendi of the proprietor of a registered trade mark, that has been understood in terms of registry immunity linked to the positive dimension of the exclusive right on the trade mark
